1. The “Kesh King Money Back Offer” (The Offer) is exclusively brought to its consumers by Emami Ltd (The Company) and is valid against a minimum purchase of 200ml of Kesh King Oil (KKO) (200ml as a cumulative of multiple SKUs is allowed) within the promotional period of 1st January 2020 to 31st March 2020 (both days inclusive).
  2. By participating in The Offer, the Customer unconditionally agrees to be bound by these Terms and Conditions including any modifications, alterations or updates.
  3. The Offer is open and valid for the Customers Residing in India, and above the age of 18 years as on the start date of this offer. Employees of Emami Limited, their immediate family members, its advertising agencies, its distributors / Sub-Stockist or Super-stockist or Retailer or Wholesaler are not eligible to participate in the Offer. Also persons reporting regularly to the company, sponsor or advertiser under a contract of service and who, by the nature of the service, may have a direct & personal knowledge of the promo are disqualified from joining the offer.
  4. Emami Ltd. (herein called ‘The company’), reserves the right, at any time, to verify the validity of claims including a claimant’s identity, age and place of residence and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the company to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. The decisions of the company will be final & binding on all participants regarding all aspect of this claim including whether the claims are genuine or otherwise. The company also reserves the absolute right to amend, change, modify, cancel, update, alter, withdraw or terminate this offer at any point of time with respect to any parameter associated with this offer without any further information / further notice. Upon such premature suspension, cessation, withdrawal, termination or closure of the Offer, no person including the Consumer shall be entitled to claim loss of any kind, direct or indirect or consequential loss or damage, whatsoever against the Company
  6. Incomplete, indecipherable, illegible, tampered claims will be deemed invalid.
  7. To be eligible for money back offer consumers must:
    1. Purchase KKO bottle (cumulative purchase volume should be 200 ml or higher) from any store within the promotional period (from 1st January, 2020 to 31st March, 2020).The purchased bottle needs to have a manufacturing date post 1st July, 2019.
    2. Use KKO following the instruction as mentioned on the pack/leaflet.
    3. Use the product three times a week of a total of 90 days.
    4. Ensure to retain outer carton & bottle of KKO & invoice of purchase.
    5. Use the product three times a week of a total of 90 days.
    6. Be a subject of no reduction in hair fall count inspite of the usage of the product in compliance of the aforesaid terms.
  8. To register, consumers needs to adhere to the following steps:
    1. Registration to be done within 7 days of buying the product (date of purchase as reflected in invoice)
    2. Dial on the Customer Care Number (Toll Free) mentioned on the KKO pack and follow the IVR to get details regarding money back challenge
    3. Once the audio gets disconnected, the customer will receive a SMS with a hyperlink
    4. Clicking on the hyperlink will lead the customer to the registration form for money back challenge campaign.
    5. Customer has to fill the form and provide details as per the questions asked and this entire process will be secured via OTP based authentication of phone number.
    6. Customer has to upload an image of its fallen hair within 5 days of registration. The image to be clicked in compliance of clause 8 Point J enumerated hereinafter.
    7. Customers needs to actively track their hair-fall condition
    8. Customer will receive reminders through SMS along with hyperlink to upload their hair fall picture at a 30-day frequency post successful registering for the money back challenge
    9. Customer will then need to click on the hyperlink and log-in using their phone number & OTP based authentication mechanism
    10. Criteria for picture to be uploaded on the web form, which will ask for photo upload, are as mentioned below.
      1. Customer to part their hair into 2 halves (left & right) and run the comb equally in both the halves for about 1 min each.
      2. Collect the fallen hair on a white surface (Towel, sheet, paper, etc) to visualize the count of hair strands / volume. Short hair strands (about 1 cm or less) should not be collected.
      3. The above steps needs to be done only after washing your hair, preferably with Kesh King Shampoo.
      4. Consumers then need to take a picture of the fallen hair strands
      5. Customer should take a zoomed-in Picture of the white surface with fallen hair.
  9. Refund Request
    1. Post using KKO for 90 days, if the eligible consumer finds no reduction in hair fall count, they can claim for a refund.
    2. The claim refund process has to be initiated between 90 and 120 days of registration, all other request would not be considered & will be treated as null & void.
    3. A Link would be shared via SMS post 90th day for feedback. Refund can be claimed from that link only.
    4. To claim refund, the customer needs to log-in to the web-form link using their registered phone number (OTP based log-in)
    5. After logging in they would need to share the feedback on the product or click on the button to "Claim refund"
    6. Once they have clicked on the button, they will be asked a few additional questions.
    7. Once they have successfully filled in the requisite details they will receive a SMS
    8. The SMS will have the courier details & requirements that they need to send for verification for receiving the refund
    9. The customer needs to then send across the KKO bottle/s along with the outer carton (depending on SKU they purchased, it could be 1 or multiple bottles)
    10. Customer also needs to send across the invoice which clearly mentions the product name & purchase date
    11. Customer is also expected to keep the courier POD safely with him/her till the time the refund process is completed
  10. All postage cost incurred while making the claim shall be borne by the claimant.
  11. Claim is valid if all the requirements as stated above are completed. Claimants must retain a copy of their cash memo as proof of purchase. Failure to produce the proof of purchase for their claim when requested may, in the absolute discretion of the company, result in invalidation of the claim and forfeiture of any right to the offer.
  12. The Company makes no representation or warranty of any kind whatsoever, whether expressed or implied, including, but not limited to, meeting of consumer’s aspirations, timeliness, security of the Offer and/or any delay or failure to avail the Offer including due to technical or network problems or any other reasons. To the extent Consumer choose to avail this Offer, Consumer to do so at his/her own initiative and Consumer shall remain responsible for compliance with the Terms and Conditions herein. Consumer agrees not to hold the Company, its officers, directors, employees, affiliates, and agents or representatives liable for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by consumer or any participant or third party, in connection with the Offer or arising otherwise. Granting of money back to eligible consumer availing the instant offer shall not tantamount to and / or be deemed to be admission on the part of the Company about any alleged or purported deficiency / defect of the product. The instant offer is merely a part of promotional activities.
  13. Claims are limited to one per person.
  14. Amount can be claimed only in respect of the price of KKO subject to a maximum amount 320. The company’s decision is final and no correspondence will be entered into. The company shall not be held responsible or liable if courier package is mis-placed in transit.
  15. The company will collect personal information of the concerned consumer to enable it to conduct the offer. In administering such offers, the company usually discloses claimant’s personal information to organizations to whom the company outsources functions, such as call centers, mailing houses and organizations associated with the offer.
  16. All claims i.ney Back Offer become the property of the company. By submitting a claim, unless otherwise advised by the claimant, each cn this Mo of Rs. 320
  17. Claim documents submitted must be received by the company within 30 days after completion of 90days of application period. Claim forms received post 30th day will not be processed irrespective of the date of purchase. This date would deem to be the cessation date for operation/ claim under this offer.
  18. All valid and accepted claimants will receive a Paytm credit to their account of Rslaimant consents to accept the information they have submitted with their particulars being entered into a database and the company may use this information to contact the claimant with exclusive offers and updates for products from Emami Limited without any reference or payment or other compensation to the claimant.
  19. Any dispute will be subject to Court at Kolkata jurisdiction only.
  20. The Company shall not be responsible or liable for any loss or damage of any claim amount , database due to any Act of God, Government actions, Force Majeure circumstances or any other reason beyond its control, and will not be liable to pay any amount or compensation whatsoever to any consumer for any loss arising there from.

  22. The offer as stated above will be guided by relevant Indian Law.
  23. All claims are subject to verification by the Company. The Company reserve the right to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process without further information to the consumer.
  24. It is mandatory for the consumer to use minimum of 200 ml during the 90 day campaign period for effective results. 200 ml usage regime is derived from 5 ml consumption in single usage multiplied by approximately 40 usages over the course of 3 months (thrice a week for 3 months).
